1. Scope
These terms and conditions apply to the use of the paid version "Trendcurve Pro" (referred to as "Pro") within the Trendcurve iOS app (referred to as the "app"). The provider is:

By purchasing Pro you accept these terms.
2. Subject matter
Pro extends the free base version of the app with additional features, in particular the forecast with target date, milestones, balance, monthly reports, body measurements, trend markers, long chart ranges, sharing the trend as an image, the iCloud backup and the larger widgets. The exact scope of features follows from the respective description on the Apple App Store at the time of purchase.
We continue to develop the app. The scope of features may therefore change over time. We will inform you in good time about significant restrictions to existing Pro features.
Trendcurve is not a medical device. Trend, forecast and milestones are statistical projections from your own measurements and do not replace medical advice.
3. Conclusion of contract
The contract for Pro is concluded exclusively through the Apple App Store. By confirming the in-app purchase on the App Store you enter into a contract with us. Apple acts as the payment service provider.
In addition, the Apple standard licence agreement (EULA) and the Apple App Store terms of use apply.
4. Prices and payment
Current prices for Pro can be found on the app's product page on the Apple App Store and in the app itself. All prices shown are final prices including statutory VAT.
Billing runs through your Apple ID account. Payment is processed by Apple. Apple's payment terms apply.
5. Subscription, one time purchase and cancellation
Pro is available as an automatically renewing subscription (monthly or yearly) and as a one time purchase without a subscription. You choose which option you want when purchasing on the App Store.
A subscription renews automatically for the respective period unless it is cancelled at least 24 hours before the end of the current period. If a free trial is offered with the yearly subscription, the paid period begins immediately after the trial ends unless you cancel beforehand.
Cancellation is done via the subscription management in your Apple ID settings:
- Open Settings on your iPhone
- Tap your name → Subscriptions
- Select Trendcurve Pro and tap Cancel subscription
You can also reach the management screen in the app under "Settings & more → Manage subscription & purchases". After cancelling you can continue to use Pro until the end of the period you have already paid for. The one time purchase remains active permanently and cannot be cancelled.
6. Right of withdrawal
Because Pro consists of digital content that is not supplied on a physical medium, Apple's withdrawal rules apply. Information about withdrawal and refunds can be found in the Apple support guidelines for subscriptions.
Apple usually offers the option to request a refund within 14 days of the purchase date. This is handled directly by Apple.
7. Availability and liability
We do our best to keep the app and Pro available at all times. However, we cannot guarantee uninterrupted availability. Temporary restrictions may arise in particular from maintenance, updates or faults.
We are liable without limitation for intent and gross negligence. In cases of slight negligence we are liable only for the breach of essential contractual obligations (cardinal obligations) and limited to the foreseeable damage typical for this type of contract. Liability for damage arising from injury to life, body or health remains unaffected.
8. Data protection
Information about the processing of your personal data can be found in our privacy policy. All health and weight data is stored exclusively on your device and is not transmitted to our servers; an optional backup ends up solely in your own iCloud account.
9. Changes to these terms
We reserve the right to change these terms with future effect where this is necessary and does not unreasonably disadvantage you. We will inform you of significant changes in good time, for example by in-app notification or email. If you do not object to the changes within 30 days of the notification, the new terms are deemed accepted. We will point out this consequence separately in the notification.
10. Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Towards consumers this choice of law applies only insofar as it does not restrict mandatory statutory provisions of the state in which the consumer has their habitual residence.
Should individual provisions of these terms be or become invalid or unenforceable, the validity of the remaining provisions remains unaffected.
